1. Acceptance of terms
SparkyCert is a trading name of Taylored Electrical Group Pty Ltd (ABN 49 689 808 633). By downloading, installing, or using the SparkyCert mobile application, or by using the SparkyCert web dashboard at sparkycert.com.au (together, "SparkyCert", "the service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the service.
SparkyCert is intended for use by licensed electrical contractors in New South Wales, Australia, and by the office staff who work for them. Section 3 sets out who may do what.
2. Description of service
SparkyCert provides a mobile application and a web dashboard that assist licensed electricians in preparing and lodging Certificates of Compliance for Electrical Work (CCEWs) with the NSW eCert system operated by the Building Commission NSW.
The web dashboard additionally lets a business manage its team and seats, keep saved customer records, view and export the business's certificate history, and buy and manage a subscription.
SparkyCert is a convenience tool and does not provide legal, regulatory, or professional advice. You are responsible for ensuring all information submitted is accurate and compliant with applicable NSW laws and regulations.
3. Who may use SparkyCert, and for what
There are two kinds of account, and they carry different responsibilities.
Licence holders. Only a person who holds a valid NSW electrical supervisor licence may lodge a certificate. Lodging a certificate — whether from the app, from the dashboard, or by approving one in your sign-off queue — is your own professional declaration, made under your own licence, about work you carried out or supervised. Nobody else can make it for you, and SparkyCert never lodges anything under your licence that you have not approved.
Office and administrative staff. A person who holds no electrical licence may hold an account and use it to prepare certificates, manage saved customers, manage the team, and manage the subscription. A certificate they prepare is not lodged: it waits in the nominated licence holder's sign-off queue until that person approves it, and is then lodged under that person's licence.
You agree that you will:
- →Only lodge or approve a certificate if you hold a valid, current NSW electrical supervisor licence
- →Not nominate a licence holder for a certificate without their knowledge, and not enter a licence number that is not your own
- →Ensure all information entered is accurate and complete
- →Not use the app to lodge false or misleading certificates
- →Keep your login credentials secure and not share your account
- →Have your customer's agreement to provide their details and any site photos to SparkyCert for the purpose of lodging the certificate
- →Comply with all applicable laws, including the Electricity (Consumer Safety) Act 2004 (NSW)
4. Subscription and billing
Every new account receives a one-time free period: 7 days of unlimited lodgements from account creation, then up to 5 free lodgements within the first 30 days of the account. After the first 30 days, lodging certificates requires an active subscription, coverage under a Business plan, or a promotional code.
Paid subscriptions are billed from the time of purchase and unlock unlimited lodgements and additional features.
How your subscription is billed, cancelled and refunded depends on where you bought it. All prices are in Australian dollars (AUD) and include GST where applicable. Pricing may change with 30 days' notice. SparkyCert does not process or store payment card details directly in any case.
Bought in the iPhone app: billed and managed through the Apple App Store. To cancel, go to Settings → Apple ID → Subscriptions on your iPhone and cancel SparkyCert.
Bought in the Android app: billed and managed through Google Play. To cancel, open the Play Store → your profile icon → Payments & subscriptions → Subscriptions, choose SparkyCert and cancel.
Bought on the web dashboard: billed by card through our payment provider (RevenueCat, using Stripe). There is no self-service cancel button for a web subscription — email support@sparkycert.com.au from the address on your account and we will cancel it for you. We aim to action a cancellation request within one business day, and it takes effect from the request regardless of when we get to it. Neither Apple nor Google can cancel a web subscription.
In every case your access continues until the end of the period you have already paid for.
5. Refunds
Bought in the iPhone app: Apple is the seller, so refund requests must be made to Apple — visit reportaproblem.apple.com or contact Apple Support. SparkyCert cannot process refunds on Apple's behalf.
Bought in the Android app: Google is the seller, so refund requests go to Google Play — visit play.google.com/store/account/subscriptions or Google's refund request form. If Google declines because their own time limit has passed, email us and we will look at it ourselves.
Bought on the web dashboard: neither Apple nor Google is involved — email support@sparkycert.com.au and we will handle the refund directly.
Nothing here limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including any right to a refund where the service is faulty or not as described. Those rights apply wherever you bought the subscription.
6. Australian Consumer Law guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied if they are not of acceptable quality.
To the extent permitted by law, any liability we have to you under the Australian Consumer Law is limited to re-supplying the relevant service or paying the cost of having the service re-supplied.
7. Limitation of liability
Subject to section 6 (Australian Consumer Law guarantees), SparkyCert is provided "as is" without additional warranties. We do not guarantee that the app will be available at all times, error-free, or that lodgements will always succeed.
To the maximum extent permitted by law, SparkyCert is not liable for any indirect, incidental, or consequential losses arising from:
- ✗Failed or delayed CCEW lodgements
- ✗Errors in data entered by the user
- ✗Unavailability of the NSW eCert API
- ✗Regulatory penalties arising from non-compliance
You are solely responsible for compliance with all NSW electrical work certification requirements. SparkyCert does not verify that submitted work meets regulatory standards.
8. Intellectual property
All content, design, code, and branding within SparkyCert are the intellectual property of Taylored Electrical Group Pty Ltd (ABN 49 689 808 633), trading as SparkyCert. You may not copy, reproduce, or redistribute any part of the app without written permission.
9. Account termination
You may delete your account at any time: in the app under Profile → Data & Privacy → Delete My Data, or on the web dashboard under Profile → Delete my account. This permanently removes your profile, certificate history and saved customers from our servers, and cannot be undone.
If you own a business account with other people still on the team, deleting your account would close the business and cut off their access, so we will ask you to hand ownership over or remove your team members first.
Deleting your account does not cancel a subscription bought through the Apple App Store or Google Play — cancel that in the store, as set out in section 4 — and does not withdraw certificates already lodged with Building Commission NSW, which are part of the government record.
We reserve the right to suspend or terminate accounts that breach these terms, submit false information, or engage in misuse of the service.
10. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of NSW courts.
11. Changes to these terms
We may update these terms from time to time. Continued use of SparkyCert after changes are published constitutes acceptance. Significant changes will be notified in-app.
